When using Kings Tutors’ website or reading any documentation produced by Kings Tutors Limited, please note that the term ‘we’ or ‘us’ or ‘Kings Tutors’ refers to the owner of Kings Tutors Limited and the term ‘you’ refers to the person using or visiting the Kings Tutors Limited website.
When using our website, you automatically accept and are bound by the Kings Tutors’ terms and conditions. You cannot use our website should you disagree with these terms and conditions in anyway.
The intellectual property rights and material on the Kings Tutors’ website is wholly owned by them unless otherwise stated. All rights are reserved.
The terms that follow dictate the use of this website:
Kings Tutors reserves the right to be able to change these terms and conditions whenever they so wish. These changes will be made known to clients and tutors in writing but changes can take place with immediate effect. These terms and conditions are the ultimate agreement when it comes to Kings Tutors, clients and tutors being involved. This means that no other terms and conditions can be put forward and agreed to by any party unless Kings Tutors provides written consent. Kings Tutors also has to agree in writing to alterations of these terms and conditions should any changes be valid.
By accepting to participate or use our services, clients and tutors are automatically showing agreement to these Terms and Conditions.
Kings Tutors will introduce the Tutor to the Client and will act as an agent on his or her behalf.
The tutor is never paid directly. Kings Tutors manages the payment of all tutors. Instead the client will receive an invoice at the beginning of each month for the previous month’s tuition. The client must then make sure that Kings Tutors receives payment within ten days of the date of the invoice. This is done by Direct Debit unless the family is prepaying for lessons.
The Client will agree the fee before any tutoring takes place. The tutor will submit an online time sheet to Kings Tutors for the work they have done with the tutee.
Kings Tutors reserves the right to request the Client’s credit or debit card details. Any credit or debit card details that the Client supplies will be held securely and may be charged in the event of late or non-payment. As such, Kings Tutors reserves the right to take payment for invoices from any payment card we may hold from the Client. Any credit or debit card details that you supply will not be passed on to any third party.
The client must agree to any extra expenses with the tutor before any tuition takes place. This might be travel expenses and schoolbooks.
No liability is accepted by Kings Tutors for any claim made by a client that is to do with the tutoring carried out by a tutor when Kings Tutors made the introduction.
Under no circumstances can the client organise a private arrangement with the tutor that was introduced by Kings Tutors. In this event, the client should expect Kings Tutors to obtain an injunction against them to stop from this happening again. The client will also be liable to account to Kings Tutors for the entire amount paid to the Tutor with no reduction in anyway.
The following is to be agreed by both the client and tutor:
The tutor and client enter into a contract together, with Kings Tutors acting as the agent on each of these parties’ behalf, when a tutoring session is confirmed.
It is compulsory for you (the tutor) to sign a copy of Kings Tutors’ Terms and Condition to confirm acceptance of these. Kings Tutors only accepts responsibility for matching up tutors that they think suitable for the tutee in question and not for what happens when the tutoring sessions take place.
You are not, after signing the Kings Tutors’ Terms and Conditions, allowed to make a private arrangement with a client introduced to you by Kings Tutors. In the event of this taking place, you will then be liable to paying Kings Tutors the amount paid to you by the client with no reduction. The tutor should then expect Kings Tutors to obtain an injunction against them to stop from this happening again.
All work suggested to a tutor by a client of Kings Tutors has to be billed through Kings Tutors on your behalf, the arrangement of billing is to be carried out in the same manner as a norm introduction by Kings Tutors would be. It is possible though to request a commission to be arranged from Kings Tutors for new clients referred to you, the tutor, by our clients.
You cannot change the fee in anyway with the client unless you have written consent from Kings Tutors. Kings Tutors will agree the amount with both you and the client in advance of the first tutoring session.
The clients will be invoiced by Kings Tutors on behalf of the tutors. The tutor must log their hours on our internal system on time each month, you will then be paid accordingly. It is up to the tutor to keep their hours logged up to date. This is so that there will be no problems if a client was to question hours as all will have been recorded and signed. The tutor is never paid directly by the client, Kings Tutors acts as the agent for the tutor. The tutor will receive payment from Kings Tutors (not the client) in the second half of each month in the preferred method that they choose – cheque or online transfer. If the tutor does accept direct payment from the client then this amount will be payable to Kings Tutors immediately and shall be actionable through the Courts straight away.
Tutors agree, under this Agreement, that it is up to them to pay tax and national insurance contribution that they are due to pay when the payments made from Kings Tutors are concerned.
For record keeping purposes, the tutor will account for the full fees paid by the client as income and the commission as expenditure.
These (books and travel) must be agreed with the client prior to each tutoring session. Receipts for everything paid for by the tutor that he/she is planning to expense must be kept as proof, also this means that books can be returned should the client then not wish to buy them. No expenses that are not agreed with the client will be repaid to you.
The client and the tutor must notify each other in advance if there are any changes to the plans that have been made for tutoring sessions as well as contacting Kings Tutors. A 24 hour cancellation policy is in place and the client will be charged if the time period is less than this. The tutor will also have to pay a charge if he/she cancels the lesson within less than 24 hours.
No liability is accepted by Kings Tutors for any claims made by the client that relates to any tutoring sessions carried out by a tutor that they have introduced. The tutor also agrees to indemnify Kings Tutors without limit in respect of any of these claims.
The information gathered from and about tutors is solely used by Kings Tutors for the services that it provides. When tutors provide Kings Tutors with information, the tutors consent to Kings Tutors using this information to arrange introductions to clients as well as being able to contact them. Kings Tutors will also use this information for payment purposes too in terms of billing and fee collecting.
The tutor is of the understanding that he or she must not at any time during this agreement, or for a period of three years after this agreement terminates, disclose to any person any confidential information that concerns the affairs, customers, clients, business or suppliers of Kings Tutors. The only exception being that you may disclose any of Kings Tutors’ confidential information if required to by law or any government or regulatory authority.
None of Kings Tutors’ confidential information can be used for anything that does not directly help you to perform your obligation to this agreement.
Acceptance of our services will be taken to represent agreement to these Terms and Conditions.
